Profile

Jonathan advises on commercial litigation, arbitration and regulatory matters, with a strong focus on PRC-related matters. He acts for local and multinational corporate and private clients in handling court and arbitration cases relating to complex commercial disputes in Hong Kong and other jurisdictions. Jonathan also deals with shipping disputes relating to cargo claims, charterparties, shipbuilding contracts, and contracts of carriage and sale of goods. He also assists clients on non-contentious matters, such as drafting and review of commercial agreements.


Representative Matters
  • Acting for an ATM manufacturer in an HKIAC arbitration relating to a claim in excess of RMB100 million arising out of patent and design disputes
  • Advising individuals and company in an HKIAC arbitration relating to a claim of repurchase of shares in a BVI company under a shareholders agreement. The amount in dispute exceeds RMB170 million
  • Advising a leading domain provider on issues of import and export of strategic commodities, including enforcement by the Hong Kong Customs and Excise Department
  • Advising a director in Hong Kong court proceedings relating to a claim arising from alleged breach of director’s duties in management of commercial property for a leading shipping company
  • Advising a Hong Kong company in Hong Kong court proceedings in opposing a summary judgment application and applying for stay of proceedings for arbitration, relating to a claim of over USD 3.5 million under sales contracts for feed additives
  • Acting for the shareholders and directors of a Hong Kong company in defending a Hong Kong court action brought by a listed real estate conglomerate in relation to a joint-venture development project in the PRC. The dispute concerns claims of alleged breach of shareholders’ agreements and share charges in excess of HKD800 million
  • Advising clients in respect of claims of outstanding loans of over HKD650 million arising out of various agreements including loan agreements, guarantees and mortgages. One of the claims has been brought by way of a mortgage action in the Hong Kong courts
  • Acting for a Hong Kong company and its director in Hong Kong court proceedings relating to alleged claims of breach of contract, fraud, and negligence. The amount in dispute exceeds USD1.5 million
  • Advising a PRC bank in discharging mortgages of vessels registered under Hong Kong flag, and on ancillary matters relating to bareboat financing, and sale and purchase of vessels
  • Acting for a Hong Kong subsidiary of a leading Japanese pharmaceutical company in defending prosecution in connection with suspected sale of unregistered pharmaceutical products
  • Acting for a PRC shipbuilding company in a London seated arbitration relating to a claim in excess of USD30 million brought by a German ship owning company under a shipbuilding contract
  • Acting for a Hong Kong company in Hong Kong court proceedings relating to a broker commission dispute with a ship seller
  • Acting for a PRC property development company in two sets of HKIAC arbitrations relating to claims in excess of USD35 million brought by a Hong Kong hotel brand company under a series of agreements for start-up of hotels in the PRC
  • Advising a foreign rolling stock company on potential challenge of a tender in Hong Kong
  • Advising clients in relation to investigations by the Hong Kong Securities and Futures Commission and the Hong Kong Monetary Authority
