Profile

Mark specializes in commercial dispute resolution. His practice focuses on cross-border commercial litigation and arbitration, mainly concerning debt recovery, sale of goods and international trade. He also advises on employment, construction and engineering and other commercial disputes. He has considerable experience in international arbitration, regularly advising on disputes conducted under various arbitration rules (e.g. ICC, HKIAC, UNCITRAL).

Litigation:

  • Acting for a high net worth individual and his company in opposing and successfully obtaining the discharge of a Mareva injunction granted in aid of foreign proceedings
  • Acting for the former CEO of the subsidiary of an international shipping line in proceedings against the shipping line for unpaid entitlements, and defending claims for breach of fiduciary duties
  • Acting for a US supplier of animal feed supplements in a dispute with its Asian distributor regarding the termination of the distribution agreement and secret profits.
  • Acting for the liquidator of an airline in proceedings to enforce a foreign court judgment in Hong Kong
  • Acting for parties opposing an application under s.34 of the Hong Kong Arbitration Ordinance challenging an arbitrator’s jurisdiction and seeking to set aside his partial award
  • Acting for a Hong Kong advisory investment company in a dispute with a private equity fund management group concerning unpaid commission
  • Acting for a Hong Kong construction company defending an injunction application seeking to prevent disclosure of ‘confidential’ information in arbitration proceedings
  • Acting for a Hong Kong contractor in a dispute concerning a performance bond
