Profile

Tony is a seasoned litigator and advises clients on commercial disputes, distressed/special situations, contentious and non-contentious restructurings, corporate insolvencies, high value trust and estate matters, and a broad range of litigation, arbitration and injunction-related disputes.

Prior to joining Zhong Lun, Tony led Freshfields’ contentious insolvency practice in Hong Kong. A former barrister, Tony maintains an active advocacy practice as a solicitor-advocate in both court and arbitration proceedings. Tony is recognised as a leading lawyer in IFLR1000 and Chambers Greater China. He is a graduate of the University of Oxford and Columbia Law School.


Representative matters

Commercial Disputes

  • Advised Peking University Founder Group on a dispute relating to the enforcement of offshore keepwell bonds with claims around US$1.7 billion.
  • Advised Credit Suisse and a consortium of investment banks on their claims in the Luckin Coffee/Charles Lu dispute, involving cross-border bankruptcy, insolvency and enforcement actions in Hong Kong, the Cayman Islands, the BVI and Canada.
  • Advised China Life on a multi-jurisdictional, complex commercial litigation involving claims arising out of a pre-IPO investment. Won summary judgment in excess of US$150 million for China Life in the Hong Kong courts. Also successfully obtained worldwide freezing orders and injunctive relief in the Hong Kong and BVI courts.
  • Advised Deloitte on defending claims brought under a shareholders’ agreement and successfully obtained a stay in favour of arbitration.
  • Advised the West Kowloon Cultural District Authority on defending claims brought against one of its wholly owned subsidiaries by a subcontractor and successfully obtained urgent injunctive relief to restrain the presentation of a winding up petition.
  • Advised the chairman of a leading social media app on his defence of claims arising out of a substantial commercial transaction, involving SIAC arbitration proceedings, Hong Kong injunction proceedings and ancillary proceedings in various US states.
  • Advised China Great Wall Asset Management in HKIAC arbitration proceedings involving substantial claims in relation to its pre-IPO investment in the Hong Kong-listed Hang Fat Ginseng Holdings Company Limited and obtained urgent injunctive and ancillary reliefs in the Hong Kong court in aid of arbitration.
  • Advised Sinovac Biotech on its dispute with dissident shareholders which involved multi-jurisdiction proceedings and applications for injunctive relief in Hong Kong.
  • Advised Sonangol Group on a shareholder dispute over the ownership and control of China Sonangol International Limited involving unfair prejudice claims and applications for injunctive relief in Hong Kong.
  • Advised a key defendant on a dispute over the control and ultimate ownership of Wind Energy Holding, a leading renewable energy company in Thailand. Successfully defended various injunction applications made by the plaintiff resulting in the withdrawal of all the plaintiff’s claims in Hong Kong.
  • Advised Huishang Bank on a dispute with one of its substantial shareholders and successful defence of an interlocutory injunction application seeking to restrain the tabling of a resolution at an EGM.
  • Advised a number of leading private equity funds in relation to their redemption right claims against distressed companies and investments.
  • Advised the co-executors of the estate of a billionaire on their defence of probate proceedings and challenges to the validity of the will, and various matters arising out of the estate.
  • Advised a key beneficiary of a substantial estate in contentious probate proceedings involving challenges to the validity of the will, family provision proceedings and defending trust claims made against her by the administrators pendente lite.
Restructuring & Insolvency
  • Advised on China Evergrande Group’s proposed restructuring of offshore liabilities exceeding US$23 billion and winding up proceedings in Hong Kong.
  • Advised HNA Aviation as the white knight investor in Hong Kong Airlines’ successful US$6.2 billion debt restructuring involving parallel restructuring processes via a Hong Kong scheme of arrangement and UK restructuring plan.
  • Advised Tsinghua Unigroup on claims and matters arising out of a proposed restructuring of the company's US$2.45 billion international bonds.
  • Advised Jiangsu Zhongnan Construction Group on the restructuring of its US$460 million NY-law governed offshore bonds and defending winding up proceedings against an offshore issuing vehicle.
  • Advised Yango Group on the restructuring of various series of its offshore bonds amounting to over US$3 billion and winding up proceedings relating to its offshore issuing vehicles.
  • Advised Dongying Fongyuan Group on the restructuring of its bank debts amounting to approximately US$4 billion and defence of winding up proceedings brought against group companies in Hong Kong.
  • Advised the ad hoc group of noteholders of Logan Group on the restructuring of more than US$6 billion of offshore senior bonds and other offshore indebtedness.
  • Advised the ad hoc group of bondholders of Helenbergh China Holdings Ltd in relation to the debt restructuring of US$657 million notes issued by the company and related winding up proceedings.
  • Advised the ad hoc committee of bondholders of Hidili Industry International Development Ltd in relation to the debt restructuring of US$400 million notes issued by the company.
  • Advised the liquidators (from PricewaterhouseCoopers) of the Shanghai Huaxin Group in the overall conduct of the liquidation proceedings. Advised on matters including the successful disposal of assets in Europe and Hong Kong, Chapter 15 proceedings in the US, applications for recognition/letters of request, litigation claims against obligors/debtors, etc.
  • Advised the liquidators (from PricewaterhouseCoopers) of Wongs Investment Development Holdings Group Limited in the overall conduct of the liquidation proceedings. Prevailed in the battle for control of its Hong Kong-listed subsidiary China Kingstone Mining Holdings Limited over the course of multiple injunction skirmishes in the Hong Kong court.
  • Advised the liquidators (from Deloitte) of the China Huishan Dairy Group in the overall conduct of the liquidation proceedings. Advised on matters including the application for and recognition of provisional liquidators, and application for compromise of debts.
  • Advised the receivers (from FTI Consulting) on enforcement actions and as the petitioning creditor in bankruptcy proceedings against Guy Lam in Hong Kong.
  • Advised BFAM Partners as the petitioning creditor in the winding up proceedings against REXLot Holdings Limited.
